The terms for using Fractal.

By creating an account or using Fractal, you agree to these terms. If you are using the iOS app, Apple's standard license terms also apply — see section 10. Read our privacy policy for how we handle your data.

Acceptance of terms

These Terms of Use ("Terms") form an agreement between you and Fractal ("Fractal," "we," "us"). By accessing or using Fractal's website, web application, or iOS app (together, the "Service"), you agree to be bound by these Terms. If you do not agree, do not use the Service.

We may update these Terms from time to time. See section 09 for how changes take effect.

Description of the service

Fractal is an AI-augmented work system. It helps you capture, organize, and plan work — tickets, cards, notes, sessions, and calendar time — and includes AI assistants that read your work state and propose actions on your behalf. You review and accept or reject what the assistant proposes; the assistant learns from both.

The Service integrates with third-party providers, including Google (sign-in and calendar), Apple (sign-in and push notifications, on iOS), and AI model providers. Details of what data is shared with each are in our privacy policy.

Accounts

  • You must provide accurate information when you create an account and keep it up to date.
  • You are responsible for maintaining the security of your account and for all activity that occurs under it.
  • You must be at least 13 years old to use the Service. Fractal is not intended for children under 13.
  • Notify us immediately at damidamichau@gmail.com if you suspect unauthorized use of your account.

Acceptable use

You agree not to:

  • Use the Service for any unlawful purpose, or in a way that violates any applicable law or regulation.
  • Attempt to gain unauthorized access to the Service, other users' accounts or data, or the systems or networks connected to the Service.
  • Reverse-engineer, decompile, or attempt to extract the source code of the Service, except where applicable law permits it.
  • Use the Service to build a competing product, or to train a model on Fractal's output at scale.
  • Interfere with or disrupt the integrity or performance of the Service, including through excessive automated use that is not part of Fractal's own agent or API surface.
  • Upload or transmit content that is unlawful, infringing, or that you do not have the right to share.
  • Post or transmit objectionable content — content that is hateful, threatening, sexually explicit, or that depicts or encourages violence — on any surface another person can see, including shared cards, comments, share links and invitations.
  • Harass, bully, threaten, impersonate, or otherwise abuse another person anywhere the Service lets you reach them.

Fractal has zero tolerance for objectionable content or abusive users. Anything another person can put in front of you — a shared card, a comment, a share link, an invitation — you can report from inside the app, and you can block the person who sent it. Blocking hides that person's comments from you and stops them sharing anything new to you.

We review reports and act on them within 24 hours. Content that violates this section is removed, and we may suspend or terminate accounts that violate it — including permanently, for anyone who harasses or abuses another person.

Subscriptions and credits

Some features of the Service consume credits, which are granted on a recurring basis according to your subscription tier, and may also be purchased separately. Credits are consumed as AI assistants perform work on your behalf (for example, running an agent task or generating a plan). Credits have no cash value, are not redeemable for cash, and are non-transferable between accounts.

On iOS, subscriptions are auto-renewable and are purchased through Apple's In-App Purchase system. By subscribing, you authorize Apple to charge your Apple ID for the subscription price on a recurring basis (weekly, monthly, or annually, as displayed at the point of purchase) until you cancel.

  • Payment is charged to your Apple ID account at confirmation of purchase.
  • Subscriptions automatically renew unless auto-renew is turned off at least 24 hours before the end of the current period.
  • Your account will be charged for renewal within 24 hours prior to the end of the current period, at the price you agreed to.
  • You can manage and cancel your subscription, and turn off auto-renewal, at any time in your Apple ID account settings — Fractal does not process cancellations directly for iOS subscriptions.
  • Any unused portion of a free trial, where offered, is forfeited when you purchase a subscription during that trial.
  • Refunds for App Store purchases are handled by Apple according to its own policies, not by Fractal.

We may change subscription pricing, credit allowances, or what consumes credits going forward. We will not change what you have already been charged for a period you have already paid for.

Intellectual property

The Service — its software, design, and branding — is owned by Fractal and protected by intellectual property law. These Terms do not grant you any rights to Fractal's trademarks, logos, or brand assets.

You retain ownership of the content you create in Fractal — your tickets, cards, notes, plans, and conversations. You grant Fractal a license to store, process, and transmit that content as necessary to operate the Service, including sending it to the third parties described in our privacy policy.

Disclaimers

The Service is provided "as is" and "as available," without warranties of any kind, whether express or implied, including warranties of merchantability, fitness for a particular purpose, and non-infringement.

Fractal's AI assistants can be wrong. Proposals, plans, and generated content may contain errors and should be reviewed before you rely on them. We do not warrant that the Service will be uninterrupted, secure, or error-free.

Limitation of liability

To the maximum extent permitted by law, Fractal will not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of data, revenue, or profits, arising out of or related to your use of the Service. Fractal's total liability for any claim arising from these Terms or the Service will not exceed the amount you paid us in the 12 months before the claim arose.

Nothing in these Terms limits liability that cannot be limited under applicable law.

Termination and changes to terms

You may stop using the Service at any time. You can request deletion of your account and its contents by emailing damidamichau@gmail.com from the address you signed in with.

We may suspend or terminate your access to the Service if you violate these Terms, or discontinue the Service, or parts of it, at our discretion. Where reasonably possible, we will give notice before doing so.

We may update these Terms from time to time. When we do, the effective date at the top of this page moves. If a change is material, we will tell you in the app before it takes effect. Continued use of the Service after a change takes effect means you accept the updated Terms.

Apple's EULA (iOS app)

If you downloaded Fractal from the Apple App Store, Apple's Licensed Application End User License Agreement applies to your use of the app, in addition to these Terms. Where these Terms are silent on a point Apple's standard EULA addresses, Apple's terms govern for the iOS app. Apple is not responsible for the Service or its content, and has no obligation to furnish maintenance or support for it; any such obligation is ours alone, as described in these Terms.

Governing law

These Terms are governed by the laws applicable to Fractal's operator, without regard to conflict-of-law principles, except where a different governing law is required by applicable consumer-protection law in your jurisdiction.
